ADDITIONAL INFORMATION ON DATA PROTECTION DA BRUNO LOVERS PROGRAMME OR DA BRUNO VIP CARD

 

Who is responsible for the processing of your data?

The interested party is informed that the personal data collected in this application will be incorporated into an automated file registered with the Data Protection Agency in the name of 1945 MALPENSA DOS, S.L., with CIF: B-92333806 and registered office in Marbella, c/ Nuestra Señora de Gracia, 26, planta baja, 29602 Marbella (Málaga), created and used by the owner in order to carry out the conditions of the promotion. In accordance with the relevant legislation, the interested parties may access, rectify, cancel and oppose said data. The application for the Da Bruno VIP card implies acceptance of the same terms and conditions and authorisation to receive specific offers regarding this promotion or others sent by the Marketing and Public Relations Department of the Da Bruno Group.

  1. For what purpose and on what grounds do we process your personal data?

Your data will be processed by Da Bruno for:

  1. Management of the Da Bruno Lovers Programme or Da Bruno VIP Card (hereinafter referred to as the VIP Programme).

The personal data collected by Da Bruno in the registration process of the programme will be processed, both automatically and, where appropriate, conventionally in order to manage your participation in the VIP Programme. By virtue of this programme you may receive offers, advantages, draws, prizes, vouchers, discounts or promotions, deferred or immediate, (hereinafter “Rewards”), specific to Da Bruno, for consumption in its restaurants in person. Da Bruno will not pass on personal data to third parties. The Rewards may be communicated to the Da Bruno VIP customer by email, SMS or WhatsApp.

The VIP Da Bruno customer declares and guarantees that all the information provided to Da Bruno through the various forms, as well as any other personal information provided to Da Bruno is true, up to date and complete, and undertakes to communicate any changes or updates to their data.

  1. Carrying out segmentation activities for the sending of commercial communications.

In order to personalise the products that may be of interest to you, Da Bruno, based on its legitimate interest, will consult internal sources and may follow an automated procedure in relation to common patterns, which in no case will produce any legal effect. Da Bruno will also consult your historical behaviour with regard to orders you may have placed in the past. In any case, in order not to prejudice your data protection rights, you may object to such processing through the channels provided for this purpose.

  1. Sending satisfaction surveys.

Da Bruno, based on a legitimate interest of the company, may send you satisfaction surveys, in order to know the experience received as a customer and to be able to incorporate the corresponding improvements based on the analysis of the same. In any case, in order not to prejudice your data protection rights, you may object to such processing through the channels provided for this purpose.

  1. Commercial actions by Da Bruno, of products, promotions and services of the VIP Programme.

Da Bruno will send you, unless you inform us otherwise, commercial communications concerning its products, promotions or services similar to those of the catering sector (by post, SMS, e-mail, WhatsApp and any telematic means), based on legitimate interest and in accordance with article 21.2 of Law 34/2002, of 11 July, on information society services and electronic commerce, unless you indicate otherwise by objecting to this through the channels provided for this purpose.

  1. Handling of complaints, claims or suggestions sent to the VIP Programme

In order to be able to correctly deal with any complaints, incidents, claims or suggestions that you may send to the VIP Programme, Da Bruno will process your data in order to reply to, rectify or incorporate them on the basis of the relationship derived from the product requested.

  1. How long will we keep your data?

Da Bruno will comply with the provisions of current legislation regarding the duty to delete personal information that is no longer necessary for the purpose or purposes for which it was collected and/or when the statute of limitations has expired to deal with possible liabilities arising from the processing of the data. Once these periods have elapsed, such information will be permanently deleted by secure means.

  1. How can you object to the processing of your data?

You may object at any time, on grounds relating to your particular situation, to:

– The processing of your data for the sending of Da Bruno’s own advertising, based on behavioural profiles, both of the VIP Programme and of Da Bruno, based on Da Bruno’s legitimate interest.

– The processing of your data for sending and receiving satisfaction surveys.

You may object to the processing of your data by sending an e-mail to marketing@dabruno.com, or by post to Da Bruno Marketing and Public Relations Department, c/ Nuestra Señora de Gracia, 26, planta baja, 29602 Marbella (Málaga). In this case, Da Bruno will cease to process the data, except for compelling legitimate reasons or for the exercise or defence of possible claims.

  1. What are your rights when you provide us with your data?

– You have the right to obtain confirmation as to whether or not Da Bruno is processing personal data concerning you and, if so, to access your personal data, as well as to request the rectification of inaccurate data or, where appropriate, to request their deletion when, among other reasons, the data are no longer necessary for the purposes for which they were collected.

– In certain circumstances, you may request the limitation of the processing of your data, in which case we will only keep them for the exercise or defence of claims.

– You may request the portability of your data to be sent directly to the entity designated by you in a structured, commonly used and machine-readable format.

If you wish to lodge a complaint of any kind, you may contact the data protection officer by sending a request to the following postal address: c/ Nuestra Señora de Gracia, 26, planta baja, 29602 Marbella (Málaga). This request must contain the following information: name and surname(s) of the User, address for notification purposes, photocopy of ID card or passport, and the specific request. In the case of representation, this must be proven by means of a reliable document.
